These Terms & Conditions govern participation in all photography tours, workshops, and related services organized by Magdalena Swiecka (“the Organizer”).
By booking a tour or workshop, participants agree to be bound by these Terms & Conditions.
General Information
1. Scope of Services
The Organizer provides photography workshops, tours, and educational experiences. Unless explicitly stated otherwise, the Organizer does not provide air transportation, travel insurance, visa services, or other services not specifically listed as included in the workshop description.
Participants are responsible for reviewing the workshop description and ensuring that they understand what is and is not included in the tour price.
2. Independent Suppliers
Certain services included in a tour or workshop may be provided by independent third-party suppliers, including but not limited to accommodation providers, transportation companies, boat operators, local guides, activity providers, and other service providers.
The Organizer is not responsible for the acts, omissions, delays, cancellations, insolvency, or performance of any independent third-party supplier.
3. Travel Documents
Participants are responsible for obtaining and carrying valid passports, visas, permits, and any other travel documents required for participation in a tour or workshop.
The Organizer is not responsible for any consequences resulting from incomplete, invalid, or missing travel documents.
Bookings and Payments
4. Booking and Payment
A booking is confirmed once a non-refundable deposit of 25% of the total tour or workshop price has been received.
The remaining balance must be paid no later than 60 days before the start of the tour or workshop.
If a booking is made within 60 days of the start of the tour or workshop, full payment is required at the time of booking.
If the remaining balance is not paid on time, the Organizer reserves the right to cancel the booking without refund of the deposit.
Payment methods and payment instructions will be provided during the booking process.
5. Minimum Participants
Tours and workshops require a minimum number of participants in order to operate.
If the minimum number of participants is not reached, the Organizer reserves the right to cancel or reschedule the tour or workshop.
In such cases, participants will receive a full refund of all payments made directly to the Organizer.
The Organizer is not responsible for additional expenses incurred by participants, including flights, accommodation, insurance, equipment rental, or other travel-related costs.
6. Cancellation by Participant
Cancellations must be made in writing.
– More than 90 days before the tour or workshop: full refund minus the non-refundable deposit
– 61 to 89 days before the tour or workshop: 50% refund of the total tour or workshop price
– 60 days or less before the tour or workshop: no refund will be issued
The Organizer is not responsible for personal circumstances that prevent a participant from attending a tour or workshop.
Participants are strongly advised to arrange appropriate travel insurance covering cancellation, illness, medical emergencies, and trip interruption.
7. Cancellation by Organizer
The Organizer reserves the right to cancel, postpone, or modify a tour due to:
– weather conditions
– safety concerns
– force majeure
– insufficient participant numbers
– operational or logistical reasons
In such cases, participants will receive a full refund of all payments made directly to the Organizer.
The Organizer is not responsible for additional expenses incurred by participants, including flights, accommodation, insurance, equipment rental, or other travel-related costs.
Participant Responsibilities and Risk
8. Travel Insurance
Participants are responsible for obtaining adequate travel insurance covering:
– medical emergencies
– evacuation and rescue
– trip cancellation or interruption
– personal belongings and photographic equipment
9. Participant Responsibility
Participants are responsible for ensuring that they are physically and mentally fit to participate in the tour or workshop.
Participants agree to follow all safety instructions provided by the Organizer, guides, and local operators.
The Organizer reserves the right to remove a participant from a tour or workshop without refund if their behaviour endangers the safety of the group, wildlife, applicable laws and regulations, or the operation of the tour or workshop.
10. Photography Equipment
Participants are solely responsible for their photographic equipment, luggage, and personal belongings throughout the tour or workshop.
The Organizer is not liable for loss, theft, damage, delay, or malfunction of photographic equipment or other personal property.
11. Wildlife and Environmental Conditions
Participants acknowledge that wildlife is unpredictable and that sightings, encounters, and photographic opportunities cannot be guaranteed.
Weather conditions, wildlife activity, environmental conditions, and safety considerations may require changes to the itinerary, activities, schedules, or locations at any time.
Participants agree to follow all instructions provided by the Organizer, guides, and local operators regarding wildlife and safety.
12. Liability
Participation in all tours and workshops is entirely at the participant’s own risk.
Outdoor and wildlife-related activities involve inherent risks, including but not limited to severe weather, wildlife encounters, remote environments, transportation risks, and physical activity.
The Organizer is not liable for injury, illness, death, loss, theft, delay, inconvenience, or damage to personal property unless caused by gross negligence or intentional misconduct.
Any costs arising from medical treatment, evacuation, rescue operations, or related services remain the sole responsibility of the participant.
13. Itinerary Changes
Tour itineraries, schedules, activities, and locations may be adjusted due to weather conditions, wildlife activity, safety considerations, transportation availability, operational requirements, or other unforeseen circumstances.
Wildlife sightings and specific photographic opportunities cannot be guaranteed.
No refunds will be issued for itinerary changes resulting from such circumstances.
Legal Information
14. Image Rights
The Organizer may take photographs and video recordings during tours and workshops for promotional, marketing, and educational purposes.
Participants who do not wish to appear in such material must notify the Organizer in writing before the start of the tour or workshop.
All photographs and other creative works created by participants during a tour or workshop remain the intellectual property of the respective participant.
15. Governing Law
These Terms & Conditions are governed by the laws of Switzerland.
Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the competent courts of Switzerland.
